Terms and Conditions/ Contract for Usage of this Online Store
Welcome to the Partnership for a Digital African (P4DA) online marketplace. This is an online store which allows third party sellers (vendors) to list and sell their goods on this website and customers/ buyers to buy these goods. The following terms and conditions are binding and enforceable for both the customer/ buyer and the Vendor. By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website if you do not agree to the Terms and Conditions.
General
- A Customer or Vendor must be eighteen (18) years of age or older and of full legal capacity.
- Unless otherwise specified, the terms and conditions stated in this document supercede those of individual Sellers/ Vendors at all times
Privacy Policy
- This is a secure website and the personal data you provide on this website is protected
- We will not disclose your personal information to anyone except your transactional partner and Yoco
- We will not sell your personal information to any other marketing agency
- Whilst we will do all things reasonably necessary to protect your rights of privacy, we cannot guarantee or accept any liability whatsoever for unauthorised or unlawful disclosures of your personal information, whilst in our possession, made by third parties who are not subject to our control, unless such disclosure is as a result of our gross negligence.
- We are entitled to use or disclose your personal information if such use or disclosure is required in order to comply with any applicable law, subpoena, order of court or legal process served on us, or to protect and defend our rights or property. In the event of a fraudulent online payment, we will disclose relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of it.
Customers/ Buyers
- A buyer/ customer is anyone who makes a purchase/s from a registered vendor on the store.
- While Vendors must register to use our online store, buyers/ customers may use the store without registering.
- By using this online store as a buyer/ customer, you are automatically bound by all the terms and conditions in this document
- The P4DA is not responsible for the delivery, supply or manufacturing of the products listed on the platform. All products are sourced and delivered by the vendors listed on the platform.
- The vendor has the right to reject an order within half an hour of the order being placed in the case of a takeaway food purchase (e.g. restaurants). For all other purchases (including from caterers), the vendor has 12 hours to reject an order. Should the customer’s payment have been processed, and the vendor rejects the order subsequently, P4DA will process the customer’s refund within 12 hours. P4DA reserves the right to charge any administration fees back to the vendor.
- The delivery time of products is specified by the vendor according to their circumstances.
- A delivery fee may be levied by the vendor, 100% of which will go to the vendor.
- Collections of goods by the buyer may be permitted by the vendor. This is totally at the discretion of each vendor.
- All deliveries/ collections must be received and signed off by buyer/ a representative of the buyer. Buyer must verify the quantity of goods at the time of collection or delivery.
Returns/ Replacements and Refund Policy
- Returns/ Replacements and/ or Refunds, within reason, may be requested in the event that a customer is unsatisfied with the product or delivery. The request must be logged within 12 hours of delivery of the product, except in the case of take away food.
- In the case of take away food, the dissatisfied customer must contact the Vendor immediately after delivery of the product to identify the problem. The Vendor must first be given the opportunity to resolve the matter with the customer. Should this fail, the customer must escalate the problem to P4DA. Complaints must be accompanied by photographic evidence.
- Customers and vendors are encouraged to reach a resolution themselves, otherwise the matter will be escalated to P4DA itself who will act as a mediator. P4DA reserves the right to charge a mediation fee to the vendor in this instance. P4DA mediation decisions are final.

Vendors
- All transactions are subject specifically to the Consumer Protection Act, 68 of 2008 (the “CPA”), and other applicable laws of the Republic of South Africa. It is the Vendor’s responsibility to ensure that these laws are complied with.
- Vendors may not list for sale goods which are deemed to be against the laws of the Republic of South Africa
- By registering as a Vendor of this online store, you are automatically bound by all the terms and conditions in this document
- Vendors are not charged any fees to register a store, maintain a store on the platform, or to list products on the platform.
- An 8% success fee will be charged by P4DA for all online transactions through the platform.
- P4DA will take payment from the customer, using a secure paygate. Payment will be made to the vendor by EFT within 48 hours of the goods being confirmed as delivered, and pending no disputes from the buyer.
- There are no contracts involved and vendors can cancel their listing by simply emailing market@digital4africa.org
- Vendors are responsibly entirely for delivery – either by themselves or through any third party service with which they may contract.
- Collections of goods by the buyer may be permitted by the Vendor. This is totally at the discretion of each Vendor.
- Vendors will be responsible for listing their own turnaround/delivery times and ensuring that they are realistic and strictly adhered to.
- All deliveries/ collections must be received and signed off by customer/ a representative of the customer. Customer must verify the quantity of goods at the time of collection or delivery.
- P4DA will provide Vendor with marketing material, advice and assistance. The Vendor will market this new channel of service to his/ her existing customer base
- P4DA reserves the right to remove a listing of any Vendor at our discretion.
Copyright, Trademarks, Authors’ Rights And Database Rights
- All content included in or made available through a P4DA Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations is the property of P4DA AND/or its content suppliers.
- You may not extract and/or re-utilise parts of the content of a P4DA Service without our express written consent from either P4DA itself or the content supplier concerned.
Reviews, comments and other communications
- P4DA reserves the right to amend or remove reviews or comments that are deemed illegal, factually untrue or otherwise inappropriate in any way (this includes the use of offensive language).
Our Liability
- P4DA is hosting an online community marketplace to facilitate easy online interactions and transactions between buyers and Vendors. As such, though we will do our best to ensure such instances do not occur, P4DA accepts no liability for any fraud, misrepresentations, misconduct, etc. on the part of either buyers or Vendors. The liability instead falls on the particular Buyer or Vendor themselves.
- P4DA has no liability for the quality of service or products. The responsibility and liability for this falls to the Vendor.
- We will do our utmost to ensure that availability of the P4DA store will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Your access to the store may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
- Should any maintenance be taking place we will communicate this and other challenges timeously, to the best of our ability.
Payment
- We provide secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
- We use Yoco as our paygate. Not only is this a secure payment portal, but it also gives customers the option to pay with different methods
- Cash payments are not allowed at this time.
